    [30/1] Georgia advised it was approved by committee as 3 people vote ( Tim Moore, Kevin, and Davorin ( owner of Unit 6, who had sold the unit on this date and in the middle of settlement )
    [30/1] John ( myself ) questioned about a. the reason of the roof water not clear , b. what will be the best way to
    repair with no gamble of spending money for nothing, c. what is the limit of committee, d, whether a unit on
    contract can still vote and suggest leave issue to general meeting for more people to discuss

    Good morning, I clearly remember Sam, owner of Unit 16 asked Jim “if committee can approve over 10,000” and Jim said not let him not to worry . I copied him in this email. Could you please check the record of last few years
    Also, about Unit 6, which is now under settlement of sale, can the vote still stand , as the payment will not be liable to them any more but the new owner, after it is settled , which might be in a couple of weeks

    Hi John,

    I have checked the minutes of the last AGM and as per motion 14 (restricted matters), the Committee do not have any restrictions. Hence, the Committee can vote on the quotation from Cross City Roofing.

    Please note, we received majority approval from the Committee approving the quote. This means that 3 out of the 5 members voted approving the quote. The Committee Members were Tim, Kevin and Davorin.

    We have followed standard practise for this matter.

    In NSW, a Strata Committee has the authority to make decisions on behalf of the Owners Corporation (all owners) unless restricted at a General Meeting which in this case they have not.

    I strongly suggest that the Strata Committee liaise amongst each other and advise me prior to the next AGM on what is required to be done at the complex, I will obtain fresh quotes and these can be presented at the AGM for everyone that is present to vote on. Otherwise, if items are left to the Committee to vote on and they do not feel comfortable, we will not be able to do anything around the complex and owners will get frustrated.

    Good day , as Alex and my previous enquiries are not replied, please kindly find below explanation that why we raised this question

    My question

    1. .how much limit committee can approve ? – According to the last few years’ general meeting with Jim, we did have an agreed limit for committee’s approval . I do not remember it is 5,000 or 7,000 , but it is definitely less than 10,000 , because the owner of Unit 16 clearly asked Jim this question at last years’ general meeting. Unless it is seriously affect the normal life of the tenant. Obviously , the 13K roof leaking repair is out of the scope of committee approval, as this leaking happened occasionally in special circumstance only, for quite a few years already .
    As agreed before , If the price over the limit, we will call for a special levy meeting.

    2. who are the majority of approval ? — I assume Tim and Kevin approved the 13K repair other than just the regular leave cleaning , although we did not see some writings on that. Alex and myself are still in the process of questioning more detail and options. So the remaining is owner of Unit 6, the nice man. We did not see he has approved and more important is Unit 6 has been sold and now is in the middle of settlement. I believe it is fair to all owners including the new owner that the current owner of unit 6 do not represent either side .

    According to above, I could not see it is a legal valid decision that the 13K repair is paid and start. And Clisdells might have to wear the cost if there is no valid approval . To avoid this, I suggest hold the work order and we discuss this further in the next general meeting which is coming soon and usually in 2nd half of March.

    I totally understand Alex’s concern. You might not already know, in the last few years, we have tried different ways and spent a lot of money on the roof leaking issues. But it still happened 2 or 3 times in last few years, as report. Removing the leaves regularly on the roof seems help somehow. As per statement in your quote, Cross City Roofing actually is not confident the leaking can be fixed after the “repair” . So that means we spend 13K for a gamble only. That is why Alex concern much about this

    So I will suggest

    1. Hold the order and leave it to be discussed in the general meeting 1.5 months later
    2. Try more methods to let more people attend the general meeting, for example , notice owners earlier, create a zoom/teams meeting room online, arrange the meeting at a convenient time .
    More people attending is very important as it is related to fair decision to every one
    I will also try my best to show the committee email communication to owners whoever I can contact , to let them know what is happening and why it is important that they attend the meeting

    At last , please kindly not make me wrong, I have no intention to make any difficulties. You can see in the past, whenever there is leaking in other people’s unit , I respond quite quickly.
    But for this case, the leaking just happened quite occasionally under special circumstance and the price is a big amount of 13K , which means each unit should pay 1,000 on it. More important is , it is not necessary can get it resolved even spending the money, I will suggest we have a big discussion about this in next general meeting. I believe this is the responsible attitude to all owners of the building.

    Can any contractor give assurance that the Leak is 100% caused by the broken tiles? Because, we might have a situation the Leak continues even after the roof tiles has been replaced. If they are certain about that, can we add this clause to the contract: that the contractor will fix the leak free of charge should the Leak continues even after the tiles has been replaced?

    Furthermore, I note that the attached quotation from Cross City Roofing for the roof repairs has been approved by Tim and Kevin. We require one further approval to proceed, noting that Alex has asked questions surround the warranty and await his response to Zoe’s email this morning.

    Thanks for your email. Our applications for tree pruning/removal are taking between 8-10 weeks for actioning at the moment. Due to both Covid and weather delays, the department are still playing catchup.

    Fitzpatrick Plumbing will be onsite on 9th, 10th and 11th August for the sewer works, weather permitting.

    He has asked that we advise the Committee that there will be minor disruption during this time.

    Morning Georgia/Zoe,

    Kevin Franklin and I have discussed.

    We both support engagement of Fitzpatrick Plumbing for Unit 11 sewer line rectification.

    They are around $1k cheaper (incl GST) and have already done the initial (emergency) clearance of the sewer line.

    May I ask that “no painting” cost mentioned below means no painting cost to Unit 11 case or no painting cost to Unit 8( 9 ? ) case ?
    I am just curious if strata paid painting cost for unit 8 (9?) , but not paying cleaning cost to Unit 11 , is that same standard ?

    Good day , I remember there was a case for unit 8 or unit 9 , Strata paid for the painting cost after fixing the leaking

    Unit 11 reported a sewer overflow in their unit this morning.

    We had Fitzpatrick Plumbing attend and rectify the issue however it has been reported that the carpet within the unit is now dirty.

    Carpet is not covered under Strata and normally we would advise the Property Manager/Owner to arrange their own carpet cleaning and claim it under landlord/contents insurance.

    May the Committee please urgently confirm if we are to follow through with this standard practise OR if out of good will Strata will arrange carpet cleaning?

    below are some data and fact
    And we can consider what is really concerning about the value of property .

    1. In the last 3 years, every year, on ons side , we were kept being pushed to double the strata levy than the last year , with the reason of a number of repair plans. In every strata meeting , it was agreed that we can raise special levy to each repair project. However, on the other side, after the strata fee was raised, there was NEVER special levy raised to any project. To many of us, the purpose is to fix the building but not just add money to the pool.

    2. There are a few problems of the building , and the root of these problems are those big trees. In the last few years, every year almost all of us all strongly want to remove those trees, If we fix those trees problem, many problems will never happen again and we can also have normal sunshine. And also , were the trees legally plant ?

    3. When the time when George was living here, we have a much lower strata fee and much better building enviroment. Just a few years past, our strata fee is nearly double and enviroment has beome bad

    4. No 52, Illawarra St ,Allawah, 15 units 42-years block, 3 bed room 120 sqm unit strata 720 , rent market value 680 per week, unit value 750K
    No 16, Gloucester Road, about 40 years block, 2 bed room strata fee 580, rent market value 450 per week, unit value 680K
    The new many-units big block opposite to central link , with lift and garden, 2 bed room strata 820, rent market value 700 per week, unit value 820k
    Ours, rent is about 380 per week, unit value, not more than 600 k per unit. strata fee is about 20% of the market rental price.
    How many people are interest to a building with lower rent income and higher strata fee.

    We do need to fix building’s problems, but can through special levy, to make the spending clear and the ensure the actions happen. We do need to fix the big trees at a higher priority because it is the source of many other problems.
